1. Acceptance of Terms
By accessing or using the custom signage, graphics, installation, artwork, or website services provided by San Jo Sign Co ("Company," "we," "us," or "our"), including our website at sanjosignco.com and all related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and San Jo Sign Co. We reserve the right to modify these Terms at any time. Continued use of our services after any changes constitutes acceptance of the modified Terms.
2. Services Description
San Jo Sign Co provides custom sign manufacturing, printing, graphics, and installation services for San Jose, nearby South Bay service areas, and accepted Bay Area projects, including but not limited to:
- Custom signs (aluminum, acrylic, PVC, Dibond, coroplast, etc.)
- Banners (vinyl, mesh, fabric, retractable)
- Decals and graphics (window, floor, wall, vehicle)
- Professional installation services
- Design consultation and artwork services
Service availability may vary by location and project type. All services are subject to these Terms.
3. Orders and Pricing
3.1 Quotes and Pricing
Each written quote states its scope, pricing, expiration, exclusions, and any applicable taxes, permits, delivery, installation, or third-party fees. Pricing or timing may change if specifications, quantities, site conditions, access, artwork, or material availability change before final approval.
3.2 Order Confirmation
Orders are not considered confirmed until:
- Written or electronic approval of the quote is received
- Required deposit or payment is processed
- Final artwork is approved (if applicable)
3.3 Deposits and Payment
Any deposit, payment schedule, accepted payment method, and balance due date will be stated in the approved written quote or invoice. Website content does not create a fixed deposit percentage or payment schedule.
3.4 Price Adjustments
We reserve the right to adjust pricing if:
- Project specifications change after order confirmation
- Material costs increase significantly between quote and production
- Additional work is required due to customer-provided artwork issues
4. Artwork and Design
4.1 Customer-Provided Artwork
Customers are responsible for ensuring artwork is:
- High resolution and suitable for the intended use
- Free from copyright or trademark infringement
- Accurate in content and spelling
- Provided in acceptable file formats (PDF, AI, EPS, SVG, PNG, JPG, PSD)

4.2 Proofs and Approval
When a digital proof is part of the project, production begins only after the required approval. Approval confirms the displayed wording, spelling, layout, dimensions, and other shown details. Material appearance and printed color can vary from a screen preview.
4.3 Color Accuracy
Colors may vary between screen displays, proofs, and final printed products due to differences in printing processes and materials. We recommend requesting a physical sample for color-critical projects.
5. Intellectual Property
5.1 Customer Materials
Customers represent and warrant that they own or have proper licenses for all artwork, logos, images, and content provided for their orders. Customers agree to indemnify San Jo Sign Co against any claims of intellectual property infringement.
5.2 Our Materials
Ownership and permitted use of custom design work, production files, and customer-provided assets are governed by the written project agreement. Original or editable production files are not included unless the written scope says they are.
5.3 Portfolio Rights
We will use project photos, customer names, logos, or completed work in public marketing only when permitted by the project agreement, the applicable relationship, or the customer's consent.
6. Production and Delivery
6.1 Timeline
Production timing is project-specific and begins only after the prerequisites in the written quote are complete. Timing can be affected by artwork approval, payment, material availability, quantity, fabrication complexity, site access, permits, outside vendors, and installation scheduling. A requested deadline is not guaranteed unless it is expressly accepted in writing.
6.2 Shipping
If shipping, local delivery, or pickup is included, the written quote identifies the method, cost, and any project-specific terms. Carrier estimates and external delivery events can affect timing.
6.3 Installation
Installation services are provided at the customer's location at the scheduled time. Customers are responsible for ensuring the installation site is accessible and prepared. Additional charges may apply for site preparation, special equipment, or scheduling changes.
7. Cancellations and Returns
7.1 Cancellation Policy
Cancellation and refund terms are stated in the approved written quote or project agreement. Custom work may involve nonrecoverable design time, ordered materials, vendor charges, permit costs, or production already completed, so no universal cancellation window or refund percentage is promised on this website.
7.2 Returns and Defects
If finished work appears to differ from the approved written specifications, contact us promptly with photos and the relevant proof, quote, or installation record. We will review the issue against the written scope and any product-specific warranty. Unless the project agreement says otherwise, custom work is not returnable merely because preferences change after approval. Issues outside the approved scope may include:
- Errors in customer-approved proofs
- Damage caused by improper installation or use
- Normal wear and weathering
- Damage during shipping (claims should be filed with the carrier)
7.3 Warranty
Product warranties vary by material and product type. Specific warranty information is provided with each quote. Warranties do not cover damage from improper use, installation, or environmental factors beyond normal use.
8. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim shall not exceed the amount paid for the specific product or service at issue
- We are not liable for indirect, incidental, special, or consequential damages
- We are not liable for lost profits, business interruption, or loss of data
- We are not responsible for delays or failures due to circumstances beyond our control (force majeure)
9. Indemnification
You agree to indemnify, defend, and hold harmless San Jo Sign Co and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Content you provide to us
10. Dispute Resolution
Please contact us first so both sides can try to resolve a dispute in good faith. Any mediation, arbitration, venue, or other dispute process must be established by an applicable written project agreement or by law; this website does not impose a county-specific arbitration promise. These Terms are governed by applicable California law, subject to any controlling consumer or jurisdictional requirements.
11. Miscellaneous
11.1 Entire Agreement
These Terms, along with any project-specific agreements, constitute the entire agreement between you and San Jo Sign Co.
11.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.
11.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
11.4 Assignment
You may not assign your rights under these Terms without our written consent.
